Matthew Lombardo's dark solo comedy Who's Holiday! is planning a limited Broadway run later this year, according to spokespeople for the play.

The news was first reported following a decision made last week by the US Court of Appeals. The court affirmed that the long-embattled play is a parody that falls under fair use. Lombardo's solo show follows a drunken, middle-aged Cindy Lou Who, who now resides in a trailer in the hills of Mount Crumpit. Dr. Seuss Enterprises has argued that the work infringes on trademarks and has tried to shut the work down.

Who's Holiday! played a limited run last winter at the Westside Theatre. Carl Andress directed the production, which starred Lesli Margherita, who received a Drama Desk Award nomination for her performance. Additional information about the engagement has not yet been released. Tony-winning producer Ben Feldman (Pippin) will serve as lead producer of the Broadway run.
